The Ordery service

Ordery is restaurant technology. Depending on the subscription and the product a business has taken, it may include a QR menu, QR ordering, the Ordery Restaurant Dashboard, the Ordery Restaurant POS and back-office and reporting features where those are made available.

What a business receives is what its subscription includes at the time. Features that are not yet released are not part of these terms and are not promised by them.

Authority to act for the business

The person who creates or manages a restaurant account confirms that they are authorised to act for that restaurant or business. Ordery may ask for evidence of that authority at any time, and may refuse, suspend or withdraw an account where it is not provided or where the authority is found not to exist.

Your account

The business is responsible for its credentials, for the staff it gives access to, for the accuracy of the information it enters, and for the security of its account. Ordery treats an action taken with valid credentials as the action of the business.

Subscriptions and fees

Ordery is sold as a subscription, monthly or annual. The price of a plan is shown before purchase and is charged in the currency stated at checkout. Applicable taxes, including VAT where it applies, may be added.

A recurring subscription renews automatically until automatic renewal is switched off. Where the feature is available to a business, automatic renewal can be switched off from the Restaurant Dashboard or from the payment provider’s billing portal.

Switching automatic renewal off does not end a period that has already been paid for. Access normally continues until the end of the paid period, and the subscription then stops rather than renewing.

A change to the price of a plan applies to new subscriptions. An existing subscription continues on the price it was taken out at until it is changed or renewed on new terms.

Orders placed by a restaurant’s customers

Ordery provides the technology through which a restaurant publishes a menu and receives orders. The restaurant remains responsible for its food and products, for the accuracy of its menu, for its prices, for tax and VAT obligations on what it sells, for allergen and ingredient information, for preparation, for fulfilling and delivering orders, for its own customer service and for any refund of an order placed with it.

Ordery does not currently receive or settle payments made by a diner to a restaurant. Ordery’s payment processing covers Ordery’s own subscription fees.

Your content

A business is responsible for having the right to use everything it publishes through Ordery, including its business name, logo, trade marks, menu text, product images and promotional material. It keeps ownership of that content and grants Ordery the permission needed to host, display and process it in order to provide the service.

Review before publication

A restaurant page published through Ordery is hosted under ordery.ae and may carry Ordery branding. Ordery may therefore review the public identity and content of a restaurant before it becomes publicly available, and may review it again when that identity changes.

Creating an account, or paying for a subscription, does not entitle a business to publication of misleading, unlawful, abusive or unauthorised public content, and does not oblige Ordery to approve it.

Restaurant names and web addresses

A restaurant is given a name within Ordery’s own domain — for example restaurant.ordery.ae. That name is a service identifier provided by Ordery. It is not a domain name owned by the business, and registering it does not create trade mark or other ownership rights in it.

Ordery may refuse a name, rename it, suspend its use, or release it so that it can be used by another business, where this is reasonably necessary because of impersonation, a trade mark or other intellectual property complaint, fraud, a misleading business identity, prohibited content, abuse, a legal requirement, or termination of an account. Ordery may ask a business to show that it is entitled to the name it has taken.

Where a name is released, only the name is released. The content, orders and account of the business it was taken from are not transferred to anybody.

Suspension and termination

Ordery may suspend the public availability of a restaurant, or access to an account, where there is fraud, impersonation, prohibited content, illegal activity, abuse of the security of the service, infringement of a trade mark or other intellectual property right, non-payment where that applies, or another material breach of these terms.

Suspension of a restaurant’s public page does not by itself cancel a subscription, and cancelling a subscription does not by itself remove a restaurant’s content.

Fees where an account is suspended or terminated for abuse

Where Ordery suspends or terminates an account because of fraud, impersonation, prohibited content, trade mark abuse or another material breach of these terms, fees already paid are not automatically refundable and may be forfeited to the extent permitted by applicable law.

Availability

Ordery aims to provide a reliable service but does not promise uninterrupted availability. Maintenance, updates, and failures of networks and third-party services can interrupt access.

Where a business uses the Ordery Restaurant POS, that software is designed to keep working at the counter during an interruption to its connection, and synchronises when the connection returns.

Intellectual property

LORANIUM TECHNOLOGIES L.L.C. retains all rights in the Ordery platform, software and branding. A business retains the rights in its own lawful content. Nothing in these terms transfers ownership of either.

Applicable law

These terms are governed by the applicable laws of the United Arab Emirates.

Changes to these terms

Ordery may update these terms. The date at the top of this page shows when they were last changed, and continuing to use the service after a change means accepting the updated terms.
